James Franco on set filming HBO drama The Deuce... after being 'subpoenaed' by Johnny Depp

He stars as twins in the HBO drama, which is getting set to air the third season. 

And James Franco was back at work on The Deuce on Friday - amid his legal woes with Johnny Depp. 

The 41-year-old actor was spotted in character on set in Times Square, New York City, after he was reportedly subpoenaed by the Edward Scissorhands star. 

Franco was shaking off the dramas in his personal life, as he was seen in 1970s garb, leaning against the entrance to the subway. 

He was sporting a moustache, and lit up a cigarette for the scenes. 

The Disaster Artist actor's outing comes after he was reportedly subpoenaed in the legal fight between exes Johnny Depp and Amber Heard.

Johnny and Amber have accused one another of physical abuse and a part of their dispute concerns an alleged altercation in 2016.

Around 11pm the day after the alleged incident, Amber and James rode the elevator together in the building she used to live in with Johnny, per surveillance video.

The footage prompted Johnny's legal team to subpoena James, The Blast reported in a post that included the video in question.

Meanwhile, HBO has set Sept. 9 as the premiere date for the third and final season of The Deuce, according to Deadline. 

Franco and co-star Maggie Gyllenhaal star as porn-industry pioneers in the drama series. 

James plays twins Vincent - who as season 2 ended seemed to be transitioning from dive bar owner to budding porn mogul - and hapless, always-in-debt Frankie. 

The Deuce - created by George Pelecanos and David Simon - chronicles the establishment of the porn industry in the early 1970s through legalization, the rise of HIV, the cocaine epidemic and the big business of the mid-1980s, with the changing real estate market about to bring the deadly party to a close.
